Liber la alegerea preşedintelui Consiliului Judeţean Hunedoara!

CJ PlenConsiliul Judeţean Hunedoara poate avea un preşedinte cu drepturi depline începînd, teoretic, chiar de mîine – dacă şi consilierii judeţeni doresc acest lucru.

Postul de preşedinte al Consiliului Judeţean Hunedoara este, în prezent, blocat. Ocupantul postului, Mircea Ioan Moloţ, deşi a fost declarat incompatibil, prin sentinţa definitivă a Înaltei Curţi de Casaţie şi Justiţie (ÎCCJ), a atacat în instanţă un act subsecvent, respectiv decizia Prefectului Judeţului Hunedoara de constatare a încetării mandatului de preşedinte CJ al lui Mircea Moloţ. Procesul se judecă, procedura este greoaie şi îndelungată. Deznodămîntul nu poate fi decît defavorabil lui Moloţ, căci o sentinţă definitivă a ÎCCJ nu mai poate fi atacată în nicio instanţă din România. Însă, pînă cînd actul administrativ de constatare a deciziei ÎCCJ nu este declarat legal de instanţa căreia i s-a adresat Moloţ, postul de preşedinte al CJ Hunedoara rămîne blocat.

Prea ocupaţi cu lupta pentru dobîndirea atribuţiilor preşedintelui suspendat, consilierii judeţeni se pare că au uitat un element esenţial: la data de 23 mai 2015, la trei zile de la publicarea în Monitorul Oficial, a intrat în vigoare noua Lege a alegerilor locale*.

Deci regula jocului s-a schimbat, între timp, şi ar fi momentul ca şi aleşii judeţeni să-şi reîmprospăteze baza pe care îşi construiesc genialele strategii de acaparare a puterii şi influenţei în Consiliul Judeţean Hunedoara.

Iată ce prevede noua lege:

Art. 101.

(1) Consiliul judetean alege dintre membrii sai un presedinte si 2 vicepresedinti

(2) Presedintele si vicepresedintii se aleg cu votul secret al majoritatii consilierilor judeteni in functie

(3) Eliberarea din functie a presedintelui sau a vicepresedintilor consiliului judetean se face cu votul secret a doua treimi din numarul consilierilor in functie, la propunerea motivata a cel putin unei treimi din numarul acestora. Eliberarea din functie a presedintelui sau a vicepresedintilor consiliului judetean nu se poate face in ultimele 6 luni ale mandatului consiliului judetean.

Aşadar, în cazul în care consilierii judeţeni vor să intre în normalitate, pot propune şi vota eliberarea din funcţie a preşedintelui Mrcea Ioan Moloţ, fără a mai ţine seama de procesele pe care acesta le are cu Instituţia Prefectului. Şi apoi pot alege un nou preşedinte al CJ Hunedoara, cu atribuţiile depline ale funcţiei, pe prevederile noii legi.

Este atît de simplu. Vor înţelege, în sfîrşit, consilierii judeţeni că populaţia judeţului îi ţine acolo nu ca să fie excursionişti pe bani publici sau ca să-şi tranşeze micile afaceri personale, ci ca să asigure funcţionarea normală a Consiliului Judeţean Hunedoara, ca nişte politicieni maturi şi responsabili?

De văzut.

P.S. Tiberiu Balint, vicepreşedintele suspendat al CJ Hunedoara, se pare că este la curent cu noua lege, aşa încît a preferat ca astăzi să-şi înainteze demisia din funcţia de vicepreşedinte al CJ, înainte de şedinţa de mîine, cînd putea fi eliberat din funcţie cu votul a două treimi din consilierii judeţeni. Deocamdată, Mircea Moloţ nu îi urmează exemplul.
